Reska is a partner of Kaplan Fox & Kilsheimer LLP and has been associated with the firm since June 2008. Mr. Reska engages in a multi-disciplinary practice focusing on real estate, estate planning and private client services. Mr. Reska is experienced in drafting, reviewing, negotiating and handling the full range of transactions, documents and other legal matters related to the real estate industry including the sale, purchase and leasing of condominiums, cooperatives, commercial properties, multi-family properties, single-family dwellings, and other types of real property in New York and New Jersey. Mr. Reska also provides counsel to property owners involved in substantial alteration and renovation projects of properties located in New York and negotiates contracts and agreements related thereto when dealing with architects, contractors, designers and other professionals. Mr. Reska also provides guidance to clients concerning §1031 like-kind exchanges and issues related thereto. Further, Mr. Reska regularly provides guidance to clients, both domestic and foreign, as to the potential tax implications associated with either acquiring or disposing of real property. This includes counseling a client who is looking to sell a property and needs advice with regards to preparing for payment of capital gains and dealing with FIRPTA withholding tax issues and possibly obtaining an individual taxpayer identification number or assisting a client who is looking to purchase a property and receive advice on how best to structure a transaction in order to minimize liability, ensure privacy, and perhaps address potential estate tax exposure which may include forming both domestic and foreign entities such as limited liability companies. Mr. Reska also provides guidance to individuals and families in estate and trust planning, asset protection, succession planning, wills, trusts, estate and trust administration, representing fiduciaries, charitable giving, pre-nuptial, post-nuptial and other domestic agreements, and fiduciary accounting. Mr. Reska further offers a variety of legal services tailored to the needs and demands of small business owners and entrepreneurs from establishing their entities to purchasing and/or selling their companies. These services include business entity formation, negotiating buy/sell agreements, confidentiality agreements, employment agreements, general releases, non-disclosure agreements, operating agreements, shareholder agreements and other related documents. Mr. Reska often engages in pro bono matters working with not-for-profit institutions. Mr. Reska earned his juris doctorate from New York Law School and his bachelor of science from Fairfield University. Mr. Reska is licensed to practice law in both New York and New Jersey and is a member of the New York City and State Bar Associations along with the New Jersey State Bar Association. Mr. Reska is also licensed by the New Jersey Real Estate Commission as a referral agent and by the State of New York to transact business as a real estate broker. In addition, Mr. Reska is licensed as a real estate instructor in New York with the ability to teach continuing education courses for real estate brokers and salespersons. In his free time, Mr. Reska enjoys spending time with his wife and three boys. They are members at the Indian Trail Club located in Franklin Lakes, NJ where they play paddle sports, swim and fish. In the winter months the family skis at The Hermitage Club at Haystack Mountain located in Wilmington, VT and enjoys time in the great outdoors.
