According to the complaint, on March 11, 2025, after the markets closed, Zynex reported their fourth quarter and full year financial results. The Company revealed a significant revenue “shortfall” in the quarter “due to slower than normal payments from certain payers.” The Company also revealed that Tricare, a health insurance program for the U.S. Military, “has temporarily suspended payments as they review prior claims.” Following this news, the price of Zynex stock fell $3.59 per share, over 51%, to close at $3.41 per share on March 12, 2025. The complaint alleges, among other things, that throughout the Class Period, Defendants made false and/or misleading statements and/or failed to disclose that (1) Zynex shipped products, including electrodes, in excess of need; (2) as a result of this practice, the Company inflated its revenue; (3) Zynex’s practice of filing false claims drew scrutiny from insurers, including Tricare; and (4) as a result, it was reasonably likely that Zynex would face adverse consequences, including removal from insurer networks and penalties from the federal government.
